Athens Utilities Water and Sewer Line Crossings

On March 13, 2009, TVA issued a finding of no significant impact (FONSI) on a proposal by the city of Athens, Alabama, to construct water and sewer pipelines with 15 crossings of Piney Creek, French Mill Creek, and unnamed tributaries to the Tennessee River at Mile 310.7, Left Bank, Wheeler Reservoir. The pipelines would also cross six wetland areas. The purpose of the project is to provide expanded water and sewer service to residential and commercial developments in the southeastern portion of Limestone County. In May 2013, the city of Athens proposed a number of modifications to its proposal including a realignment of the sewer pipeline and the installation of two permanent creek crossings. TVA’s approval of the project, as modified, is the subject of a FONSI signed in February 2014.
Because the proposed action involves the construction of obstructions and discharge of fill material in streams and wetlands, it requires approval by TVA under Section 26a of the TVA Act and by the U.S. Army Corps of Engineers (USACE) under Section 404 of the Clean Water Act. USACE has prepared an environmental assessment of the proposed action and TVA was a cooperating agency in the preparation of the EA. In accordance with Section 7 of the Endangered Species Act (ESA), USACE formally consulted with the U.S. Fish and Wildlife Service on the potential effects to two endangered species known from the project area. TVA was a party to the ESA consultation and is also subject to the required terms and conditions of the incidental take statement.
